What Fireworks are Illegal in Colorado?

The Fourth of July is just around the corner. While we celebrate the United State’s independence from British rule, millions of Americans will be enjoying the day of barbequing, throwing pool parties, and even setting off fireworks.

While certain types of fireworks are legal in Colorado, most are not—especially those that explode or fly in the air. In addition, these include fireworks bought in neighboring states such as Arizona or Wyoming.

The following are some of the illegal fireworks in Colorado:

  • Bottle rockets
  • Roman candles
  • M-80’s
  • Mortars
  • Cherry bombs
  • Firecrackers

Possession of illegal fireworks is punishable by a maximum six-month jail sentence and/or a fine of up to $750. However, in popular cities such as Denver, possession of illegal fireworks carries a jail term of up to one year and/or a fine no more than $1,000.

On the other hand, legal fireworks are small devices which emit visual or audible effects through combustion, rather than explosion. Home fireworks cannot have over 50 mg of explosive composition.

Some legal fireworks include:

  • Sparkers and dipped sticks
  • Snakes or glow worms
  • Fountains
  • Ground spinners
  • Toy propellants
  • Illuminating torches
  • Toy cabs
  • Noisemakers

Whether the fireworks are legal or illegal, individuals are prohibited from using them in state and federal parks, local parks, forests, golf courses, city streets, and most public areas.
