DWAI & DWI Defense Attorney in Denver

Technical Training Informs Your Colorado DWAI Defense

Colorado uses DWAI, or driving while ability impaired, for the lower-level charge that people often call DWI. Orr Law Firm represents clients charged with DWAI, DUI, drug-related impaired driving, and related criminal traffic offenses in Colorado.

We’ve defended well over 1,000 DUI cases. Attorney Rhidian Orr’s training includes practitioner and instructor training in Standardized Field Sobriety Tests, the roadside exercises officers use to assess possible impairment. He’s also trained on the Intoxilyzer 9000 breath-testing instrument and Gas Chromatography, a laboratory method used to separate and measure compounds in a sample. His Drug Recognition Expert Overview certification covers procedures used to investigate suspected drug impairment.

DWAI vs. DUI Under Colorado Law

DWAI means alcohol, drugs, or a combination affected a driver to the slightest degree. The allegation is that the person was less able than usual to exercise clear judgment, physical control, or due care in safely operating a vehicle. DUI uses a higher standard: whether the driver was substantially incapable of safely operating a vehicle.

A blood alcohol concentration (BAC) result measures the amount of alcohol in a person’s bloodstream. The reported number doesn’t resolve every factual or legal issue, but Colorado law permits specific conclusions based on the level.

Colorado’s BAC rules include:

  • 0.05 or less: The result creates a presumption that the driver wasn’t impaired.
  • Above 0.05 but below 0.08: The result permits an inference that alcohol impaired the driver’s ability.

A permissible inference allows the court or jury to consider impairment based on the result, but it doesn’t require that conclusion. Other evidence can include driving behavior, officer observations, roadside testing, statements, and the reliability of the test.

Penalties for a Colorado DWAI Conviction

Possible consequences depend on the charge, prior qualifying convictions, and the circumstances of the case. A first offense can affect a person’s record and daily life even though its statutory penalties differ from those for a first DUI.

A first offense carries:

  • Two to 180 days in jail.
  • A fine of $200 to $500.
  • Twenty-four to 48 hours of community service.
  • Eight points on a Colorado driver’s license.

A first conviction for DWAI doesn’t itself trigger the automatic license suspension or revocation associated with a first DUI. However, separate administrative consequences can arise from chemical-test refusal or other circumstances, so the criminal charge and license matter must be evaluated independently.

A third DUI or DWAI offense within seven years triggers a 24-month administrative license revocation. It can also lead to a habitual traffic offender designation and a five-year revocation.

DUI, DUI per se, or DWAI becomes a class 4 felony when a driver has three prior qualifying convictions. Potential penalties include two to six years of imprisonment, three years of mandatory parole, and fines ranging from $2,000 to $500,000. The sentence depends on the applicable law and case-specific facts.

What Happens After a DWAI Arrest in Denver

A DWAI arrest can create two separate proceedings: a criminal case and a Colorado DMV license matter. We address both tracks, identify the applicable hearings and court settings, and explain how each can affect driving privileges.

Under Colorado’s Express Consent law, officers with probable cause to believe a driver committed DUI or DWAI may require blood, breath, saliva, or urine testing as applicable. Express Consent refers to the testing obligations attached to driving in Colorado. A refusal can be used as evidence in court and provide grounds for license revocation.

Denver operates within Colorado’s 2nd Judicial District and has a consolidated city-and-county court system. Denver County DUI and DWAI cases are generally heard at the Lindsey-Flanigan Courthouse. Felony-level cases proceed in Denver District Court within the same complex, subject to the charge and filing decision.

We represent clients in county, district, federal, and municipal courts throughout Denver Metro and the Front Range. We also advise clients about bond conditions and requirements that may follow a plea or conviction, including probation terms, ignition interlock obligations, and other compliance steps.

How We Prepare a Denver DWAI Defense

A reported BAC result or an officer’s conclusion isn’t the end of our review. We examine the investigation from the initial driving observations through the arrest and testing, then compare the available evidence with Colorado’s legal and procedural requirements.

Our case preparation can include:

  • Traffic stop review: We examine the stated reason for the stop and whether the officer had the required legal basis.
  • Roadside procedure review: We evaluate field sobriety testing methods, instructions, scoring, and officer observations.
  • Testing analysis: We assess blood-testing procedures, breathalyzer accuracy, test administration, and relevant laboratory records.
  • Evidence comparison: We review police reports, available body camera footage, and laboratory results to build a detailed timeline.
  • Defense issue identification: We consider probable cause, identification of the driver, testing reliability, and rising BAC evidence, which concerns whether the level increased between driving and testing.

We prepare these cases with trial in mind while also evaluating negotiation options. That preparation allows us to explain the evidence, available defense paths, and possible consequences directly instead of leaving clients to interpret technical reports alone.
