Colorado DUI Defense Flawed Test/ Defective Testing Equipment

Colorado uses the Intoxilyzer 5000EN breathalyzer test machine. Breath tests, and specifically this machine can have errors and can be challenged in the following ways: if the machine was not properly calibrated; if the test was not taken in a timely basis; if there was not a sufficient observation period prior to taking the test; if the tests were taken too close together in time; if the machine detected mouth alcohol; if the test result shows you were not over the limit; if the Officer operating the machine was not certified to do so.
