Driving under the influence of alcohol, or "DUI" and Driving While Ability Impaired, or “DWAI,” are the most commonly committed crimes in the state of Colorado. A DUI in Colorado is an offense that charges that you were substantially incapable of safely operating a motor vehicle, or that your BAC was .08 or higher.
A DWAI in Colorado is an offense that charges that you were impaired to the slightest degree so that you were less able than you normally would have been to operate a motor vehicle, or that your BAC was from .05-.0799.
When we sit down to discuss your DUI Case, we will determine: What was the BAC level; Was the test done within two hours of driving; were the roadside maneuvers done correctly as required by NHTSA and was the officer certified to conduct the maneuvers; to what extent was alcohol chemically affecting the brain tissue to “impair” judgment; and what was your motor reaction and coordination when stopped; what other medications or drugs were taken; was there a problem with the breathalyzer machine; was the officer certified to conduct tests on the machine; was the blood draw done properly.
