If at any time your license is revoked for an alcohol offense, you will need to go through the process known as reinstatement to obtain a valid driver’s license after the period of mandatory revocation is over. Excess B.A.C. Driving Offenses, Effective 01/01/2009
REVOCATION: Your first episode of driving with a B.A.C. of 0.08 - .169 results in a 9-month revocation.
- The revocation remains in effect until you complete the reinstatement process.
- ALL Excess B.A.C. reinstatements are processed by mail. You should begin the reinstatement process approximately 3-4 weeks before you expect to reinstate.
- If you were 21 or older at the time of the violation, are a Colorado resident, and have no other unsatisfied license restraints, you may reinstate early after only 1 month of revocation provided you install an Ignition Interlock Device (Interlock) in every vehicle you own or may drive and meet all other reinstatement requirements.
- If your B.A.C. was below 0.17, you reinstate early, drive only an Interlock vehicle and do not have any B.A.C. when you drive, you may be eligible for an unrestricted license after 4 consecutive months of successful Interlock driving. REINSTATEMENT (9-month revocation): If you choose not to reinstate early with Interlock, the following is required for full reinstatement:
1. Provide an SR22 Certificate from your insurance company and maintain it for 9 months following reinstatement (3 years if you were involved in an accident).
2. Complete an Alcohol Certification, Form DR2598.
3. Complete an Application for Reinstatement, DR2870.
4. Mail the SR22 Certificate, the Alcohol Certification and the Application along with your personal check or money order for $95.00 to the address provided on the Application.
VOLUNTARY INTERLOCK EARLY REINSTATEMENT:(1-month revocation plus 8-month Interlock requirement): In addition to items 1-4, you must maintain the SR22 Certificate for the period in which you hold a restricted license unless you were involved in an accident as accidents mandate a 3 year SR22 requirement, and:
5. Have an Interlock installed in every vehicle you either own or may drive (call any provider for appt.).
- Include the notarized Restricted License Ignition Interlock Agreement Affidavit, DR2058.
- Include a signed copy of each interlock lease agreement and of each installation certificate.
While your privilege to drive is Interlock restricted:

EARLY REINSTATEMENT (1-month revocation plus 2 year Interlock requirement): In addition to items 1-4, you must maintain the SR22 Certificate for the period in which you hold a restricted license and approximately 3 weeks after the DMV receives your application with ALL required documents, they will send you a Letter of Clearance. You MUST then apply for a license at any Colorado Driver's License Office. Only after you have the license in hand is it lawful for you to drive.

When a driver refuses a chemical test for drugs or alcohol for a first offense, the period of revocation is for 1 year. There is no early reinstatement for refusals.
REINSTATEMENT REQUIREMENTS:
- Application for Reinstatement (DR2870) form;
- $95.00 reinstatement fee (check/money order payable to the Department of Revenue);
- SR22 Certificate for one year from date of reinstatement if there are no other alcohol convictions or revocations and no accident was involved; SR22 for three years from date of reinstatement if there was a prior alcohol violation or if there was an accident;
- Certification (DR2598) form completed
TESTING:
A new license must be obtained by taking the eye, written and driving test.
2nd Offense BAC .080 or greater
Revoke Per Se .08 - Second Offense
- One year revocation for second offense. There is no early reinstatement for multiple offenders. The revocation remains in effect until you complete the reinstatement process.
- ALL Excess B.A.C. reinstatements are processed by mail. You should begin the reinstatement process approximately 3-4 weeks before you expect to reinstate.
REINSTATEMENT REQUIREMENTS:
- Application for Reinstatement (DR2870) form;
- $95.00 reinstatement fee (check/money order payable to the Department of Revenue);
- SR22 Certificate for three years from the date of reinstatement;
- Enroll in and complete Level II Alcohol Education and Therapy;
- Include the Affidavit of Enrollment, DR 2643.
- Have an Interlock installed in every vehicle you either own or may drive (call any provider for appt). You will be required to have Interlock for two (2) years.
- Include the notarized Restricted License Ignition Interlock Agreement Affidavit, DR2058;

Revoked - Two Refusals
When a driver refuses a chemical test for drugs or alcohol for a second offense, the period of revocation is for 2 years. The driver may request early reinstatement after completing one year under revocation. They then are eligible for a restricted license with interlock for the time remaining on the total restraint or 2 years, whichever is longer.
REINSTATEMENT REQUIREMENTS:
- Application for Reinstatement (DR2870) form;
- $95.00 reinstatement fee (check/money order payable to the Department of Revenue);
- SR22 Certificate for three years from date of reinstatement;
- Certification (DR2598) form completed

This restraint is taken when a driver receives two alcohol violations within a 5 year period. The revocation is ordered for a period of one year and you are not eligible for early reinstatement.
REINSTATEMENT REQUIREMENTS:
- Application for Reinstatement (DR2870) form;
- $95.00 reinstatement fee (check/money order payable to the Department of Revenue);
- SR22 for three years from date of reinstatement;
- Level II alcohol education and therapy course is required.
- Include the Affidavit of Enrollment, DR 2643;
- In addition to the above requirements the Ignition Interlock Device must be installed if one alcohol offense occurred on or after 7/1/00;

You must hold a restricted license for at least one year prior to applying for a regular driver license. If offense occurred on or after July 1, 2004 the interlock requirement and restricted license must be held for two (2) years.
TESTING:
A restricted license must be obtained by taking the eye, written and drive test in an interlock vehicle.

This restraint is taken when a driver receives three or more alcohol violations over the lifetime of the driving record. The revocation is ordered for a period of 2 years and you are eligible to reinstate early after serving one year of the mandatory revocation period.
REINSTATEMENT REQUIREMENTS:
- Application for Reinstatement (DR2870) form;
- $95.00 reinstatement fee (check/money order payable to the Department of Revenue)
- SR22 Certificate for three years from date of reinstatement;
- Level II alcohol education and therapy course is required.
